Just this past Saturday, July 19th, Illinois Governor Pat Quinn signed House Bill 5701, which prohibits a private employer or employment agency from inquiring about or considering an applicant’s criminal history until the applicant has been determined to be qualified for the job and selected for an interview. The new law does not apply to certain jobs where employers must exclude applicants with criminal histories. The new legislation will become effective January 1, 2015. Illinois joins a growing list of cities and states seeking to prohibit employers from making any inquiries or requiring any person to disclose or reveal any criminal conviction information until after the initial interview.
